"The Court would wish to record its deep appreciation of the expert assistance rendered by the two Conciliators, Mr. Firdosh Karachiwala and Ms. Rajani Iyer. They have in a true sense discharged their responsibility which lawyers as officers of the Court are expected to perform. Parties and their counsel have deeply appreciated their assistance. In view of the settlement between the Parties, nothing further survives in the petition for review. There shall be an order in terms of the Consent Terms.”.....

Mahatma Gandhi a practicing Lawyer was disgusted with the Legal System and saw the deterioration of the entire system in South Africa and in India and resorted to Mediation. In his Autobiography on Page 133-134, Mahatma Gandhi has written on Mediation as follows:
Quote “……But both were happy over the result, and both rose in the public estimation. My joy was boundless I had learnt the true practice of law. I had learnt to find out the better side of human nature and to enter men’s hearts. I realized that the true function of a lawyer was to unite Parties riven as under.
The lesson was so indelibly burnt into me that a large part of my time during the twenty years of my practice as a lawyer was occupied in bringing about private compromises of hundreds of cases. I lost nothing thereby- not even money, certainly not my soul.” Unquote.

Abraham Lincoln who was a practicing lawyer and also discouraged litigation and he wrote as follows:
Ouote “Discourage litigation. Persuade your clients to compromise, whenever you can. Point out to them the nominal winner is often a real loser; in fees, expenses and waste of time. As a peace-maker, the lawyer has a superior opportunity of being a good person.” Unquote.

President John F. Kennedy also reduced the litigation and has stated Quote “Let us not negotiate with fear but let us not fear to negotiate” Unquote.

The Hon’ble Chief Justice of India Shri. V.N.Khare before retiring has said
Quote “Let us hope the coming years would be years of “Conciliation, Mediation and Arbitration” and not of “Litigation”. Unquote.

Hon’ble Justice M. B. Shah in one of his speeches has said
Quote “It is to be remembered that delay in disposal of cases has affected the entire system. To some extent, it is malignancy because unscrupulous litigants take advantage of such delays. For removing this malignancy, surgery is must. That surgery is to be performed by the Chief Justices of the High Court and the District Judges all over the country. It is expected that Surgeon should not have shaky hands. He must be confident of what he is expected to do. Further, it is for the Judges or Chief Justices of the High Courts to see that the procedure prescribed under the CPC is strictly followed”. Unquote.

A Chinese proverb states:- “It is better to die of starvation than to become a thief; it is better to be vexed to death than to bring a law suit”.
